Asbestos Claims

Asbestos is a naturally occurring mineral and was first mined over 4000 years ago. However, it was not until the end of the 19th century that the mining of Asbestos became very prominent in modern industry. The mining of Asbestos peaked worldwide in the mid 1970’s.

Asbestos has many unique properties and uses and because it is relatively inexpensive, industry historically has used Asbestos in many forms. However, despite it’s obvious benefits, workers using or working with Asbestos have for decades been exposed to the dangers associated with inhalation of Asbestos dust and fibres.

Many industries in which Asbestos was historically used exposed their workers and members of the public to high levels of Asbestos dust and fibres without any regard for their health and safety.

The Health & Safety Executive reported in 2009 that there were in excess of 4,500 deaths recorded in the UK which were directly related to Asbestos exposure. This in modern times is unacceptable.

The conditions associated with Asbestos exposure are:

  • Mesothelioma (a form of cancer commonly affecting the outer lining of the lung)
  • Lung Cancer
  • Asbestosis
  • Pleural Thickening
  • Pleural Plaques

The above conditions result in varying degrees of injury and associated symptoms. Pleural Plaques will not normally cause any degree of physical disability and will only be detected after the sufferer has undergone a chest x-ray or a CT scan of the chest.

Pleural Thickening and Asbestosis can often restrict the lung capacity and this can result in shortness of breath and tiredness on exertion. Both these conditions often continue to deteriorate after a diagnosis has been made.

Mesothelioma and Lung Cancer are by their very nature the two most serious conditions associated with Asbestos exposure. Both these conditions can invariably result in the significant reduction of life expectancy of the person suffering with the condition.

However, the other conditions listed above can also have a serious debilitating affect on the sufferer and their families.

Despite knowledge in the early 20th century that Asbestos carried with it major health risks, many industries failed to put in place relatively inexpensive measures to ensure Asbestos exposure was prevented or minimised.

Industries where Asbestos exposure is frequently encountered are:

  • Steel Works and Foundries
  • Power Stations, Power Plants, Boiler & Turbine Houses
  • Factory Environments
  • Construction Industry
  • Asbestos Removal
  • Insulation and Fire Proofing Industry
  • Manufacturing of Asbestos Products
  • Demolition and Construction Disposal
  • Heavy Goods Vehicle Maintenance

Frequently Asked Questions

  • Can I bring a claim against an employer who is no longer trading?

Yes, a claim can be pursued if the insurers of the company can be identified. MRH Solicitors have access to various resources to assist in identifying insurers of defunct companies.

  • I was last exposed to Abestos many years ago, can I still succeed with a claim?

Illness from Asbestos exposure can occur up to 35 years or longer after the last exposure to Asbestos occurred. Therefore this is not a bar to making a claim.

  • I was given respiratory protection to protect me from the inhalation of Asbestos, does that mean I cannot claim?

Even if respiratory protection was provided to you at some point during your employment, this does not mean you cannot still succeed with a claim.

  • I think I was exposed to Asbestos, but I am not sure?

At MRH Solicitors, we have an extensive bank of information relating to the likely instance of Asbestos exposure in most industries. One of our team will be able to advise you on whether your employment was likely to involve exposure to Asbestos.

  • I have been diagnosed with Pleural Plaques due to Asbestos exposure can I still make a claim?

In short, unless the exposure to Asbestos occurred in Scotland, the answer is no. The House of Lords has ruled that Pleural Plaques does not constitute an injury which should be compensated. However, we still recommend you to contact the specialist industrial disease department at MRH Solicitors for further information and advice.
